7 Mandatory Clauses for NDIS Compliance

The NDIS Quality and Safeguards Commission and auditors require clear agreements that protect participant choice and control while establishing clear operational boundaries. Ensure your agreements contain these seven vital elements:

Parties & Legal Nominee Authority

Clearly identify the participant, plan nominee, child representative, or legal guardian, citing nominee authority under the NDIS Act 2013.

Schedule of Supports with Item Codes

State exact support item numbers (e.g. 01_011_0107_1_1), agreed hours, frequency, and whether funds are Agency-Managed, Plan-Managed, or Self-Managed.

NDIS Pricing Arrangements & Price Caps

Explicitly reference compliance with NDIA gazetted price limits and define how annual indexation adjustments are handled without support disruption.

Short Notice Cancellation Policy

Specify the clear business day notice window (2 business days for standard supports / 7 days for complex) to ensure billable claims withstand audit scrutiny.

GST-Free Supply Declaration

Confirm the supply qualifies under Section 38-38 of A New Tax System (Goods and Services Tax) Act 1999 so invoices are issued GST-free.

Complaints & NDIS Commission Contact

Mandatory provision of internal complaints contacts plus the NDIS Quality and Safeguards Commission toll-free complaints hotline (1800 035 544).

Agreement Term & Expiry Tracking

Clear commencement and expiration dates matching the participant plan review date to prevent unbilled services when plans rollover.

The NDIS Expiry Blind Spot: When Agreements Quietly Lapse

The most frequent compliance finding during NDIS verification audits isn't missing clauses, it is delivering and invoicing supports under an agreement that expired months ago when a participant’s plan rolled over. Always tie agreement expiration to plan review dates and set automated 30-day renewal reminders.

Why Manual Word Templates Cost NDIS Providers Hours Every Week

Most Australian disability providers start with Word docs or generic DocuSign templates. Here is why specialized NDIS signing infrastructure makes the difference.

Word Docs & Generic E-Sign
  • ✕Manual Data Copying: Staff re-type participant names, NDIS numbers, and addresses across multiple files, creating errors.
  • ✕Silent Plan Expiries: When a participant's NDIS plan rolls over, agreements lapse unnoticed. Services continue unbilled or get rejected by plan managers.
  • ✕Mobile Signing Friction: Participants struggle to download PDFs or remember DocuSign login passwords on their smartphones.
  • ✕Unenforceable Cancellations: Outdated or vague cancellation terms get rejected by the NDIA or cause participant disputes.

Under the NDIS rules, a written agreement is legally mandatory for Specialist Disability Accommodation (SDA). For Core, Capacity Building, and Capital supports, while verbal agreements are theoretically possible, the NDIS Quality and Safeguards Commission and Plan Managers strongly require a written agreement to establish informed consent, billable item codes, and enforceable cancellation terms.
