Between Apex Abilities Care and the Participant
1. Parties and Intent
This Service Agreement is made between Apex Abilities Care (ABN: 12 345 678 901) ("the Provider") and the participant or their authorized representative ("the Participant"). The purpose of this agreement is to ensure a clear understanding of supports to be delivered in accordance with the Participant's NDIS plan.
2. Schedule of Supports & Pricing
The Provider agrees to provide Personal Care and Community Access at agreed rates that do not exceed the limits specified in the official NDIS Pricing Arrangements and Price Limits. Support hours, frequency, and delivery locations are detailed in the Schedule of Supports schedule attached hereto.
3. Cancellation and Short Notice
If the Participant needs to cancel or reschedule a scheduled support, at least 7 business days clear business days of notice must be provided. In the event of short notice or a no-show where the rostered worker cannot be redeployed, 100% of the agreed fee may be charged to the Participant's NDIS funding.
4. Invoicing and Payment Terms
Invoices will be issued fortnightly or upon completion of service, payable within 7 business days from date of issue. Invoices will be submitted directly to the designated Plan Manager, the NDIA, or the Participant (if Self-Managed).
5. Feedback, Complaints and Dispute Resolution
The Participant has the right to provide feedback or lodge a complaint at any time. Complaints can be directed to the Provider's management team or directly to the NDIS Quality and Safeguards Commission (1800 035 544 or complaints@ndiscommission.gov.au).
6. Privacy and Record Keeping
The Provider will collect and store personal information strictly in accordance with the Privacy Act 1988 (Cth) and NDIS Practice Standards. Evidentiary records of service delivery and signed agreements will be retained securely for a minimum of seven (7) years.
